The services may include but are not limited to: wall and floor tiling, bathroom renovations, shower rebuilds, waterproofing, leaking showers, floor screeding, leaking balconies, stone/paving, tile sealing and grouting.</p> </li> <li> <strong>Changes to Scope</strong> <p>Any modifications to the scope of work must be agreed upon in writing by both parties. Such changes may affect the overall cost and completion timeline. North Suburban Tilers will provide a revised quotation for any additional work not covered in the original scope.</p> </li> </ol> </li> <li> <h1>Payment Terms</h1> <ol> <li> <strong>Deposit</strong> <p>A non-refundable deposit of up to 30% of the total contract value is required to secure the commencement of the work. The deposit amount will be specified in the quotation/estimate.</p> </li> <li> <strong>Progress Payments</strong> <p>For projects extending beyond 7 days, progress payments may be required. These payments will be based on the completion of specific milestones as outlined in the quotation/estimate.</p> </li> <li> <strong>Final Payment</strong> <p>Final payment is due upon completion of the work and before the release of any final documentation or certification. Payment must be made immediately after completion.</p> </li> <li> <strong>Late Payments</strong> <p>Late payments will incur interest at a rate of 2% per month or the maximum rate allowed by law, whichever is lower. North Suburban Tilers reserves the right to suspend work until outstanding payments are made.</p> </li> </ol> </li> <li> <h1>Warranties and Guarantees</h1> <ol> <li> <strong>Workmanship Warranty</strong> <p>North Suburban Tilers warrants that all tiling work will be performed with reasonable skill, care, and in accordance with industry standards. This warranty covers defects in workmanship for a period of 7 years from the date of completion.</p> </li> <li> <strong>Material Warranty</strong> <p>Materials used in the tiling work will be covered by the manufacturer’s warranty, if applicable. North Suburban Tilers will provide the client with any relevant warranty information for materials used if requested.</p> </li> <li> <strong>Exclusions</strong> <p>This warranty does not cover damage resulting from misuse, alterations, neglect, accidents, or any factors beyond the North Suburban Tilers control. This includes, but is not limited to, damage caused by water leakage, structural issues, or improper maintenance.</p> </li> </ol> </li> <li> <h1>Limitation of Liability</h1> <ol> <li> <strong>General Limitation</strong> <p>To the fullest extent permitted by law, the North Suburban Tilers liability for any claims arising from or related to the tiling services provided is limited to the total amount paid by the client under the invoice. This limitation includes but is not limited to direct, indirect, consequential, or incidental damages.</p> </li> <li> <strong>Indirect Damages</strong> <p>North Suburban Tilers is not liable for any indirect, special, incidental, or consequential damages, including but not limited to loss of use, loss of profits, or loss of property value.</p> </li> <li> <strong>Force Majeure</strong> <p>North Suburban Tilers shall not be liable for any failure to perform its obligations under the quotation/estimate due to events beyond its control, including but not limited to natural disasters, strikes, or other force majeure events.</p> </li> </ol> </li> <li> <h1>Client Responsibilities</h1> <ol> <li> <strong>Site Conditions</strong> <p>The client is responsible for ensuring that the work site is prepared and ready for the North Suburban Tilers personnel. This includes providing access to the site, ensuring the site is clean and free from obstructions, and providing any necessary utilities.</p> </li> <li> <strong>Permits and Approvals</strong> <p>The client must obtain and provide all necessary permits, approvals, and consents required for the completion of the work. North Suburban Tilers will not be responsible for delays or additional costs resulting from the client’s failure to obtain these permits.</p> </li> <li> <strong>Existing Conditions</strong> <p>The client must disclose any pre-existing conditions or damage that may affect the tiling work. North Suburban Tilers is not responsible for any issues arising from undisclosed conditions or pre-existing damage.</p> </li> <li> <strong>Site Preparation</strong> <p>The client must take all precautions by covering and protecting any surfaces where North Suburban Tilers personnel may be working. This includes, but is not limited to floorboards, tiles, decking, driveways, garden beds and lawns. North Suburban Tilers is not responsible for any dust or debris left over from work related activities.</p> </li> </ol> </li> <li> <h1>Damage and Repair</h1> <ol> <li> <strong>Precautions</strong> <p>North Suburban Tilers will take reasonable precautions to avoid damage to the property during the execution of the work. However, the client acknowledges that minor damage to surrounding surfaces may occur.</p> </li> <li> <strong>Damage to Property</strong> <p>North Suburban Tilers is not liable for damages to fixtures, fittings, or other property unless such damage is caused by negligence or willful misconduct by the North Suburban Tilers personnel.</p> </li> <li> <strong>Repairs and Rectification</strong> <p>In the event of damage caused by the North Suburban Tilers, North Suburban Tilers will repair or rectify the damage to the extent feasible. This is limited to the original scope of work and does not extend to pre-existing conditions or additional costs incurred.</p> </li> </ol> </li> <li> <h1>Complaints and Disputes</h1> <ol> <li> <strong>Notification of Issues</strong> <p>Any complaints regarding the work performed must be submitted in writing within 7 days of completion. North Suburban Tilers will address the complaints promptly and make reasonable efforts to resolve any issues.</p> </li> <li> <strong>Resolution Process</strong> <p>North Suburban Tilers will engage in discussions with the client to resolve any disputes amicably. If a resolution cannot be reached through direct communication, disputes may be referred to mediation or arbitration.</p> </li> <li> <strong>Arbitration</strong> <p>Disputes that cannot be resolved through mediation may be submitted to arbitration. The arbitration process will be conducted in accordance with the rules of Arbitration Victoria, and the decision will be final and binding.</p> </li> </ol> </li> <li> <h1>Termination</h1> <ol> <li> <strong>Termination by Client</strong> <p>The client may terminate the work if North Suburban Tilers fails to perform its obligations in a timely manner. The client must provide written notice of termination, specifying the grounds for termination.</p> </li> <li> <strong>Termination by Company</strong> <p>North Suburban Tilers may terminate the Agreement if the client fails to make timely payments or breaches any material term of the Agreement. North Suburban Tilers must provide written notice of termination, specifying the grounds for termination.</p> </li> <li> <strong>Consequences of Termination</strong> <p>In the event of termination, the client will be liable for payment for all work completed up to the termination date. Any materials or equipment supplied by the North Suburban Tilers but not used in the work will be returned or paid for by the client.</p> </li> </ol> </li> <li> <h1>Governing Law and Jurisdiction</h1> <ol> <li> <strong>Governing Law</strong> <p>These Terms and Conditions are governed by and construed in accordance with the laws of Victoria Australia.</p> </li> <li> <strong>Jurisdiction</strong> <p>Any legal actions or proceedings arising out of or related to these Terms of Service shall be brought exclusively in the courts of Victoria, Australia. Both parties consent to the personal jurisdiction of such courts.</p> </li> </ol> </li> <li> <h1>Miscellaneous</h1> <ol> <li> <strong>Entire Agreement</strong> <p>These Terms of Service, together with any written Agreement, constitute the entire agreement between the parties and supersede all prior discussions, agreements, or understandings of any kind.</p> </li> <li> <strong>Severability</strong> <p>If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.</p> </li> <li> <strong>Waiver</strong> <p>No waiver of any term or condition of these Terms of Service will be deemed a further or continuing waiver of such term or condition or any other term or condition.</p> </li> <li> <strong>Assignment</strong> <p>North Suburban Tilers may assign its rights and obligations under these Terms of Service to any third party.
